Frequently Asked Questions About Divorce

Our team of experienced Encino divorce lawyers is always available to help answer any questions our clients have about their divorce and California family law. Here is a collection of frequently asked questions:

What are some common reasons for divorce in California?

People seek divorce for many complicated reasons. Some of the most common issues that lead to a marital breakdown include:

  • Incompatibility issues
  • Emotional and physical infidelity
  • Financial, emotional and physical abuse
  • Substance abuse disorders
  • Lack of intimacy
  • Money difficulties
  • Unrealistic expectations

The most common reason given for divorce is “irreconcilable differences,” which is a no-fault option that does not assign blame to either spouse.

Under normal circumstances, how long does the divorce process take?

There are a few factors that can determine how long the divorce process can take. If spouses can reach an amicable divorce agreement that covers all marital matters (asset division, child custody, alimony, etc.) and proceed with an uncontested divorce, then a divorce can be finalized after the mandatory six-month waiting period. However, if spouses disagree about the terms of their split at any point, then the divorce process can take much longer. A contested divorce that goes to court may take a year (or even longer) to finalize.

How can children add complexities to a divorce?

When minor children are involved in a divorce, parents have to discuss child custody and financial support issues – and these can quickly become contentious. Child custody determines each parent’s right to make major decisions for their children and how much parenting time they have, while support reflects each parent’s obligation to provide financially for their minor children.

Can I file a divorce in California if my ex-spouse moved out of state?

Yes. So long as you have lived in California for at least six months and in the county where you intend to file for the past three months, you may still initiate a divorce within this state – even if your spouse has moved away. Your spouse will still need to be properly “served” or notified of the divorce proceedings, however.
